Our understanding is that there is currently no country where only HTTPS
access to Wikipedia is blocked. In Iran
<https://en.wikipedia.org/wiki/Censorship_of_Wikipedia#Iran>, the
government appears to have been blocking select Wikipedia articles at
different times.[1] The Great Firewall of China
<https://en.wikipedia.org/wiki/Censorship_of_Wikipedia#China> has also been
blocking select articles on Chinese and English Wikipedia.[2] While it
previously blocked all HTTPS access to Chinese Wikipedia, that block has
more recently been extended to HTTP access as well. The transition to HTTPS
by default therefore shouldn't block anyone's access to all of Wikipedia
due to censorship. Rather it should help prevent censorship of select
Wikipedia articles, which we know is a problem in different parts of the
world.

I should also mention that while we try to be as transparent as possible in
all our work (including holding community consultations around all major
legal policies and providing frequent updates on our work), there are very
limited situations where public discussions could actually hurt free access
to Wikipedia. If you have thoughts about the evolving censorship landscape,
feel free to email me directly, if possible via encrypted email.

With respect to Wikipedia Zero, we have been working with mobile carriers
for over a year to make sure that they are able to provide access free of
data charges over HTTPS. For many carriers, this required them to adjust
the technical implementation of how they waive data charges. We are now
finally ready to transition Wikipedia Zero access to HTTPS by default.

As Gayle mentioned in her email, the article in the Washington Post did not
represent an official position on net neutrality from the Wikimedia
Foundation, or how we understand Wikipedia Zero. I wanted to provide some
background that does.

Wikipedia Zero is designed to empower people who cannot afford to access
information to get basic access to knowledge and participate in the
creation of knowledge. It’s widely understood that barriers like poverty
and limited internet connectivity are two major blockers preventing people
around the world from full access to knowledge, and there are a number of
groups working to address these issues as part of the broader Access to
Knowledge (A2K) movement.

Wikipedia Zero is a powerful tool for accessing knowledge, but it is not
the solution to the whole problem. It’s one tool in a toolbox. Real change
needs to address issues such as cost barriers, literacy, and access to
infrastructure. That’s why we’re also developing a more coordinated effort
within a broader A2K coalition to collectively address the systemic
challenges.

While Wikipedia Zero serves broader A2K objectives, we are mindful that
zero-rating can be a challenging issue for net neutrality advocacy. In
response, we’ve developed ten operating principles
<https://wikimediafoundation.org/wiki/Wikipedia_Zero_Operating_Principles>
to make sure that the initiative remains a free knowledge base with
operations that are transparent to users.[1] They are intended to deter
Wikipedia Zero from being used to introduce other zero-rating initiatives
that don't follow the operating principles. We developed these principles
after extensive consultation with net neutrality advocates about their
concerns regarding commercial zero-rating arrangements, and believe they
are strong and useful guidance for advocates to distinguish free access to
Wikipedia from other zero-rating programs.

We’ll continue working with policymakers on net neutrality and welcome your
constructive suggestions in this regard. We believe the vision of Wikimedia
— the sum of all knowledge, available to all — and the values of an open
internet are entirely consistent and in the global public interest. We’re
also learning from your comments and welcome more input on how the
Wikimedia community can support the A2K movement.

confusion.

CC BY-SA 3.0 grants users the right to use an image under copyright law. It
does not cover trademark rights. The goal of trademark rights is to protect
the logo from being used in a way that confuses the public. Trademark
protection only covers certain types of uses, which are not the same as use
covered with a copyright license like CC BY-SA 3.0. The Wikimedia trademark
policy provides how the logos can be used as trademarks and here is some
discussion about why it does that:

So are the logos "free" under the Free Culture Definition? Yes, because the
definition only talks about freedom under copyright law and lists CC BY-SA

The relicensing applies to the Wikimedia logos, which refers to all the
logos of the Wikimedia wikis:
https://wikimediafoundation.org/wiki/Wikimedia_trademarks. It also applies
to all the derivatives that carry the {{Copyright by Wikimedia}} template
on Commons.  Essentially, the objective is to get rid of that last non-free
license template. I'm traveling for a conference, but I will see if I can
clarify the blog post on this as soon as I have better internet connection.

To address Allan's question, this does not affect the trademark status of
the logos as governed by the new trademark policy:

Gerard: Labs is not currently considered for zero-rating because it can be
misused. But it may be added over time if we figure out how to work around
that and there is demand for it.

Rupert: Your comment seems unnecessarily hostile to me, but I'm going to
try to assume good faith. I have of course edited Wikipedia articles in my
spare time, though I may not do it as much given that I spend most of my
time defending the projects legally and creating a safer environment for
other editors.

To address your substantive point: that people need full Internet access to
do research for Wikipedia articles. I do think there are ways the community
could work with editors that have limited access to the Internet rather
than dismissing them outright. The fact that people can't afford to pay for
full Internet access should not exclude them from contributing to the
projects.

As the Quartz article from Jens's email discusses, the decision in Chile is
very unfortunate.[1] It's an example of when net neutrality — which is an
important principle for the free and open internet — is poorly implemented
to prevent free dissemination of knowledge. Although Wikipedia Zero is not
yet available in Chile, it is a country of interest for the program, so we
are thinking about what options are available in light of this decision.

That said, I would like to clarify a couple of points about the
implementation of Wikipedia Zero that were raised in this thread:

1. The newer Wikipedia Zero partnerships have provided the full Wikipedia
sites (m.wikipedia) free of data charges for some time now and we are
phasing out the reduced version (zero.wikipedia) from the older
partnerships.

2. While earlier Wikipedia Zero partnerships only zero-rated Wikipedia, we
are working on getting carriers to zero-rate all the Wikimedia projects.

3. We are also working on getting editing functions zero-rated, though
there are some technical hurdles for that right now. But, eventually,
Wikipedia Zero will not only make knowledge more accessible, but also
empower more people in the Global South to contribute to the projects.

4. Finally, WMF does *not* pay carriers to zero-rate Wikipedia under
Wikipedia Zero. Carriers zero-rate the sites because they want to make a
commitment to access to knowledge as a corporate social responsibility.[2]
I believe this question has already been answered in this thread since
Scott raised it earlier, but I just wanted to confirm that Wikipedia Zero
does not involve payments.

[Wikimedia-l] [Wikimedia Announcements] WMF Board approval of new Trademark policy and recommendation on the Community logo registration

Hi all,

We are happy to announce that the Board of Trustees approved the new
Trademark Policy this Saturday.[1] The policy is based on a seven-month
consultation with the community to replace our 2009 policy. The new policy
is unconventional in how it provides expansive use of the Wikimedia marks.
Thanks to the community's collaboration, the policy is more readable,
thorough, and consistent with our values.

The Board also approved our recommendation to withdraw trademark
registration and protection for the Community logo.[2] We will now initiate
withdrawal of US and worldwide registrations.

Many thanks to everyone who participated in these two consultations!

We are happy to announce the completion of the new Wikimedia trademark
policy.[1] We first launched a community consultation to gather input for
the first draft of this policy on June 3, 2013.[2] The first draft was then
discussed and significantly revised in a second consultation.[3]

Many thanks to everyone who participated in this discussion over the past
seven months. Your detailed feedback resulted in significant improvements
to the policy.[4] The new policy is more readable, thorough, and consistent
with our values, thanks to your collaboration. We look forward to
recommending the final draft to the Wikimedia Board.

Hi all,

The Wikimedia legal and community advocacy team invites
you[1]
to participate in the development of the new Wikimedia trademark
policy.

The current trademark
policy[2] was
introduced in 2009 to protect the Wikimedia
marks [3].
We are now updating this policy to facilitate permissive use of the
marks, while respecting the legal requirements for preserving them for the
community. The new draft trademark policy is ready for your review

encourage you to discuss it

Hi all,

We would like to take this opportunity to thank everyone who has
constructively participated in the ongoing trademark practices consultation
that we started several months ago.  Please feel free to continue your
participation there, since all issues continue to remain open for
discussion.[1]  We would also like to invite community members to join the
ongoing discussion regarding the trademark protection of the Community logo
that we posted on Monday:

 Our goal is to obtain clear direction from the community on how we should
proceed with respect to the registration of the Community logo and whether
we should pursue a collective membership mark for the community.

Our current consultation is part of an ongoing discussion regarding this
logo. We joined this discussion on the talk page for the Community logo and
Wikimedia thematic organizations.[2]  We then initiated a broader
discussion on trademarks in June, where the discussion on the Community
logo continued.[1] That trademark practice discussion remains open and
active, and we have been responding to a wide array of important issues
thanks to community comments.

We were first notified this weekend of a potential opposition to the
trademark registration,[3]  an issue not raised earlier in the community
consultation on trademark practices even though the deadline for the
opposition was not until December 22.  We accordingly initiated a community
consultation on Monday about how you would like us to handle this.[4]
Indeed, this is consistent with the legal team’s ongoing efforts over the
last two years to include the community in important legal decisions and
policy proposals. We have put a strong emphasis on a close working
relationship with the community, such as in our discussions on the Terms of
Use, the Privacy Policy, the Conflict of Interest Guidelines, the Legal
Fees Assistance Program, the Political Affiliation Policy, and now the
Trademark Policy.[5]

In our ongoing consultation regarding the Community logo, we have asked the
community to let us know whether to seek a collective membership mark
(which will help maintain protection against misuse by others, while
allowing free use by community members) or to abandon the registration of
the trademark and its protection by WMF.[4]  Collective membership mark is
an idea that we started researching a couple of months ago in light of
community comments in the trademarks discussion and had planned to present
it after finishing the research.

To be clear, we have no emotional investment in the outcome. This
consultation is the community's opportunity to let us know how the mark
should or should not be protected. As we stated before, we are fine
abandoning the trademark registration to put our limited resources against
other priorities, but this decision belongs to you and the Board [6]. To
ensure full community participation, we have invited users from all across
the world to take part in this and continue to encourage that.[4]

Our actions will be based on the community consultation underway and the
Board, not on an extra-community legal action.  We understand that an
opposition against the Community logo trademark has been filed, and we will
handle it as we do all litigation.  The litigation deadlines are a
non-issue to us because we will do what the community and Board tell us.
 Our goal is to determine the broader community intent through a community
consultation that is open to everyone. If the community and Board tell us
that we should abandon registration, we will do so; if you want it
protected, let us know.

We just issued an announcement on the Wikimedia Blog that the
Wikivoyage community has selected an official logo [1]:

Hi all,

On Friday, the Legal and Community Advocacy team posted a call for
community input on our trademark policy and practices:

We have identified some trademark practices that we think are going well,
as well as some areas that could be improved. We have also raised specific
questions for discussion and seen great community engagement on this issue.
To date, community members have provided excellent input on how the
trademark policy can be clarified [1] and started translating our initial
trademark statement [2] into German, Greek, Spanish, French, Hebrew,
Italian, Korean, Russian, and Swedish to make the discussion more
approachable internationally. We would like to get as many community
members as possible to participate in the discussion and look forward to
your comments.
