Do you think the website violates Wikipedia / WMF copyrights ? The site has
nothing to do with Wikipedia or its cause too.

The website was probably created by a fan who does not understand
trademark law. Hardly worth giving legal attention to.

(1) The website or the domain name use is non-commercial;
(2) The content does not demonstrate that the website is affiliated to
Wikipedia or sister-projects in any manner;
(3) The website does not use the Wikipedia or Wikimedia logo.

I think the Foundation should stick to defensive use of trademark law.

I would think using the word wikipedia can be considered as passing off, it
may not violate copyright law but it is guilty of passing off, taking
advantage of the brand equity created by others at considerable cost.

Just bringing into the attention of all.
Now that Mike is away, who is the next in charge for legal affairs ?

This is interesting!!
The whole wikipedia is about giving away, sharing what you know and
the content is all under CC.
But here is a strong thought to protect and hold on to the copyrights
of wikipedia !!

I have not checked the license of the wikipedia logos. If they are
modifiable and redistribution of modified images are allowed, will
such images still remain as wikipedia property? Can I use such
images/content on my website (any website for that matter) ?

Generic speaking, what happens to logos and names and other such
intellectual properties in such cases?

Wikipedia / Wikimedia foundation is usually very generous in terms of
using-reusing its intellectual properties, especially by *anyone who is
supporting the cause or outreach*.

The below site has to do nothing with wikipedia but intends to just sell
by piggy bagging on the name of wikipedia. IMO, the website can be
considered commerical with .com registration and also use of Google Adsene
for revenue generation.
What was more disturbing for me, was its twitter profile
http://twitter.com/#!/indiawikipedia display image. We have already have big
issues by repeatedly stating wikileaks has to do nothing with wikipedia ..
No surprises if some media tommorrow says Indian wikipedia promotos nude
content due to this :)

On related note, I wanted to recollect the earlier legal history of
wikipediaart.org http://wikipediaart.org/legal-history/ . This letter is
worth reading http://wikipediaart.org/legal/032309-Isenberg.jpg

Re: [Wikimediaindia-l] indiawikipedia ?

2010-11-30 Thread Ravishankar
I think they use it in the sense Wikipedia = Encyclopedia (they are covering
India related news). Like Xerox machine became synonymous with photo
copying.

People might even mistake any wiki for Wikimedia projects. Probably there
are 100s of sites like this all over the world.

Unless someone is misusing Wikipedia trademark intentionally, we better let
them go off. An NPO like Wikimedia should not waste its resources in petty
issues.

What an odd website. Thanks for pointing this out Tinu. I think it
does violate WMF IP - copyrights and trademarks, if any.

Thank you.
