I would think using the word wikipedia can be considered as passing off, it may not violate copyright law but it is guilty of passing off, taking advantage of the brand equity created by others at considerable cost. _ Pravin Gandhi emails: pravingandhi...@msn.com work email: p...@pravingandhi.com website: www.pravingandhi.com blog:www.pravingandhino1.wordpress.com linkedin:in.linkedin.com/in/pravingandhino1 facebook/twitter: pravingandhino1 skype/gtalk: pravingandhino1 From: anirudh...@gmail.com Date: Tue, 30 Nov 2010 14:48:26 +0530 To: wikimediaindia-l@lists.wikimedia.org Subject: Re: [Wikimediaindia-l] indiawikipedia ? Re: [Wikimediaindia-l] indiawikipedia ?
Wikipedia / Wikimedia foundation is usually very generous in terms of using-reusing its intellectual properties, especially by *anyone who is supporting the cause or outreach*. The below site has to do nothing with wikipedia but intends to just sell by piggy bagging on the name of wikipedia. IMO, the website can be considered commerical with .com registration and also use of Google Adsene for revenue generation. What was more disturbing for me, was its twitter profile http://twitter.com/#!/indiawikipedia display image. We have already have big issues by repeatedly stating wikileaks has to do nothing with wikipedia .. No surprises if some media tommorrow says Indian wikipedia promotos nude content due to this :) On related note, I wanted to recollect the earlier legal history of wikipediaart.org http://wikipediaart.org/legal-history/ . Re: [Wikimediaindia-l] indiawikipedia ?
I think they use it in the sense Wikipedia = Encyclopedia (they are covering India related news). Like Xerox machine became synonymous with photo copying. People might even mistake any wiki for Wikimedia projects. Probably there are 100s of sites like this all over the world. Unless someone is misusing Wikipedia trademark intentionally, we better let them go off. An NPO like Wikimedia should not waste its resources in petty issues.
