Attached is WISPA's Opposition to CenturyLink's Petition for Waiver, which
seeks to re-designate certain "served" areas on the National Broadband Map
as "unserved" in cases targeting 56 WISPs. CenturyLink's Petition
identified two categories of WISPs: (1) the relevant state did not verify
mapping information showing more than 10 miles of "unbroken" coverage
resulting in an understatement of "unserved" areas, and (2) "technologically
inferior" service coupled with either high prices or low data caps.
I believe the Opposition makes very good arguments to counter CenturyLink's
claims, assumptions and methodology. Since circulating the first draft last
week, Jack Unger and I worked on this quite a bit over the last several days
to add some new thoughts and polish the document. In particular, Jack was
very helpful on technical issues.
Yesterday, Jack (by phone) and I met with six FCC personnel, including
Michael Steffen (the Chairman's Wireless Advisor) and Julie Veach (the new
Wireline Bureau chief) to preview the Opposition. They asked a lot
of questions about WISP operations, speeds and system architecture, and our
answers helped support our position that not all WISPs are alike -- they use
different spectrum, have different business practices and operate in
different environments. Our 45-minute meeting was very productive and,
afterwards, the FCC folks met privately.
In addition to WISPA's Opposition, our firm also filed Oppositions for nine
of the targeted WISPs. Others have filed as well. I expect the FCC to act
quickly in light of the upcoming July 24 certification deadline.
Meantime, WISPA is writing another press release.
