[WISPA] 38GHz Spectrum Usage

Outside of the distance sensitivities, is there a clear reason why one would or would not want to use this band? If it's readily available in my area, while the FCC bands are quite congested, would there be anything in particular to compel me to keep away from it and figure out how to use one
