AFAIK, no - they are not required to use 4.9 GHz exclusively. Although reguirements will vary depending on the group's needs and the recommendations of their techical people, there is no regulation that I know of that would prevent them from using the license-free frequency bands where they deem it appropriate. Other folks on this list may have other, more-specific information.
