My son has the following query:
He is employed on an H1-B visa with company ABC in the United States.
He has also started the H1 process with another company XYZ. The H1
approval notice for XYZ is expected to come through by end December.
Currently, he has left the US on vacation - scheduled to return to the
US the first week of Jan 2000.
If the H1 approval notice for company XYZ comes through and is Fedexed
to him in time by his lawyers (of company XYZ) in the US, what are his
options? Can he return to the US using XYZ's H1 and then resign from
ABC on arrival in the US.
Also, his US visa expires in Feb 2000 (marking the end of the first 3
years of his allowable 6 years of H1). He would like to get an
extension/renewal of the US visa. To do so, must he show ABC's
H1 approval notice (i.e, his present employer) or could he use XYZ's H1
approval notice (since he plans to switch to XYZ anyway on returning to
the US)?
