Kosovo refuses to hand over evidence on Radoicic to Serbia

The Kosovo government has turned down Serbia's request for cooperation in the 
Banjska case and for evidence related to the wanted Milan Radojicic, the Kosovo 
Justice Ministry said in response to a statement from the US ambassador to 
Kosovo that Serbia had sought legal assistance from Kosovo regarding the 
Banjska case. 

According to Kosovo’s Ministry of Justice, Serbia’s request contradicts Article 
85, Paragraph 1, Items 1.2 and 1.3 of the Law on International Legal 
Cooperation in Criminal Matters.

“Furthermore, under Kosovo’s Criminal Procedure Code, only Kosovo’s judicial 
authorities have the jurisdiction to investigate and prosecute cases alleged to 
have occurred on Kosovo’s territory,” the Ministry stated.

The Kosovo Ministry said Serbia initially refused cooperation in this case, as 
those suspected of the terrorist attack in Banjska were, according to Kosovo 
authorities, trained in Serbia.

It said that the Kosovo Special Prosecutor’s Office in 2023 submitted a request 
for mutual legal assistance to Serbia through the Department of International 
Legal Cooperation, but that Serbia never responded.

“Serbia must respond to requests for the extradition of criminals so they can 
be brought to justice in Kosovo. An international investigation is also needed 
into terrorist training camps in Serbia and Serbia’s involvement in financing 
and arming terrorists,” said the Ministry.
