Menubar and Dock still accessible in capture mode on Mac OS X 10.6.2

Bug description:
When trying to select a region of the Menubar at the top of the screen
the active application switches to Sikuli in the middle of selecting a
region to capture which makes it impossible to capture a menu in your
desired application.
We are running Mac OS X 10.6.2 with latest Java updates and can not
upgrade to 10.6.3
