I could be wrong, but my reading of the Gujju's perceived faults are that he wrote spam software because someone paid him to. While this is certainly unethical, it's not illegal. I know of some reasonably large software development organizations in India, some even employing thousands of people who have done business with spammers or otherwise questionable clients. And usually, even when the questionable background of the client has been gently pointed out, they have persisted.
The lure of money is too great even for well established money making organizations, let alone a poor coder for rent.
