They NOW have the power thanks to the new legislation.
Most 'legislation' is territorial in nature - ie, it only applies to areas where Congress has what is called 'exclusive legislative jurisdiction'. This includes Washington DC, property within any State where jurisdiction has been officially ceded (most federal buildings do *not* qualify*), and Territories (I think Guam and American Samoa), and to an extent, places like the U.S. Virgin Islands, Puerto Rico, etc.
In other words - Congress does NOT have unlimited power to legislate inside the States.
Any Act of Congress the enforcement of which would be unConstitutional is not a legitimate law.
