Also, given that at these UN Codex Meetings its one country, one vote, with even tiny little countries like Norway having as much voting power as much larger countries such as the United States with zero consideration given to population size, to be consistent, that means that any comment, from any individual, must in turn carry as much weight in terms of a "vote" as the comments from large trade associations such as CRN, NNFA, CHPA, GMA, and others- otherwise, the voice of the American consumer would be effectively SQUELCHED! Additionally, I would like to make an appointment with either ,Ellen Anderson, Dr.Yetley, or Dr.Wehr (or all 3) (and anyone else at FDA) for the sake of discussing the following things with you: 1) I attended your public meeting re the implementation of the Pearson Court decision, and as you are well aware you are currently being sued yet again by Emord and Associates on behalf of Durk Pearson and Sandy Shaw, Dr.Julian Whittaker, APMA and others... You are also very aware of the petition that you've received from Grocery Manufacturers of America wherein they have demanded that you stop dragging your feet on implementing the Pearson court decision. I urge you to ACT RIGHT and NOT force GMA to sue you too! As you know, they have VERY deep pockets, and in the end, you'll just have egg all over your faces even worse than you currently do, so why prolong the agony? All of us are painfully aware of our political reality with you guys. We're all painfully aware that many people go to work for the FDA, then leave seeking better paying jobs with the private sector--- with multinational pharmaceutical companies. I don't need to cite specific examples, because I know that you are well aware of this and I don't need to tell you. I have spoken with former FDA employees who have discussed with me in minute detail the prevailing mindset that exists within the FDA and I am well aware of all of your unwritten rules. Here is my first question: As a person who recovered from a life threatening illness 21 years ago via a suppressed alternative treatment mode (orthomolecular medicine) all I want are two things: 1) To be left in peace to live my life without FDA interference in terms of access to the nutrients for which I have a genetic need, and: 2) For other people to have the same chance I've had in which to heal and for everyone to stop being harrassed by you guys vis a vis their access to supplements. Many people on my email distribution list have life threatening genetic situations. Many owe their lives to alternative medicine. I would just like to meet with you to share some of this information with you for the sake of expanding your awareness. 3) FDA Attorney Melinda Plaiser has attempted to assure Congressmen Burton,Paul, Cook, Stump, and De Fazio that our concerns re Codex are "groundless".... that our interpretation of GATT is incorrect. I strongly disagree, and would like to discuss my concerns with you in detail as one of the protestors who was in both Seattle and DC protesting against the WTO/WB/IMF. 4)I emailed you my comments with attached articles: A Rebuttal to the NAS Risk Assessment Paper, and Darlene Sherrell's expose on NAS's fraudulent fluoride data. I'd like an appointment to come in to discuss my comments directly with you prior to the next FDA Codex meeting May 18th. By now I'm sure you must recognize that there is an international groundswell of _OUTRAGE_ against the WTO. See http://indymedia.org for an ACCURATE picture of what REALLY happened in Seattle. I was there. I saw what went on with my own two eyes. Everyone on the IAHF email distribution list is painfully aware of the grossly undemocratic way in which the WTO and UN operate. They are outraged that they are being "represented" at Codex by someone who was never elected, who can't be voted out of office, and who routinely ignores the people, Congress, and the Courts- by someone who clearly regards herself to be above the law: Beth Yetley. This goes directly against our whole system of representative government and it is very disturbing to us. People are outraged that the United States with our large population doesn't have any more voting power in this sham of a Codex process than tiny little Norway, tiny little Togo, and other tiny little countries many of which don't even MANUFACTURE dietary supplements and whose populace has no experience with them. So: Another question I'd like to ask is this: Have you ever been on the website of Global Trade Watch and seen the section called "Harmonization Alert"? http://www.tradewatch.org It shows numerous examples in which the so called Dispute Settlement Body of the WTO making rulings wherein they threaten to impose trade sanctions against broad segments of our economy unless we "harmonize" our laws to international standards. I just want to know if you've reviewed this site, and if not WHY NOT? (Presumably you're attempting to act in the best interests of American dietary supplement consumers--- but I see no evidence of that- the impression I have is that you are being scripted by your old colleague John Hathcock of CRN whose every word you listen to attentively DESPITE the strong scientific objections which INDISPUTABLY expose the conflict of interest at NAS! I'm not stupid, I can see the writing on the wall. I can see the direction everything is heading in, and it is anti consumer and therefor intolerable. FDA is charged with protecting the public health. In some ways you're properly fulfilling your Congressional mandate, but in many other, very ALARMING ways, you are NOT! There needs to be a dialogue about this. In 1989 I had a meeting with Dr.Gary Dykstra in the Parklawn Building. He brought about 50 other people into his office when we met. I was not intimidated. Feel free to do the same thing again- the more of you who hear what I have to say the better. He was attempting to do things that threatened my life and the lives of others and I needed to talk face to face with him. I feel the same need today, to have a dialogue with you and to see some transparancy and fairness in this process which seems entirely too.... OPAQUE. That is.... highly NON TRANSPARENT! It is painfully obvious to a growing number of American and International dietary supplement consumers that the FDA is attempting to pay LIP SERVICE to upholding US law, while in REALITY you're doing everything humanly possible to help build CONSENSUS on the Codex vitamin issue so that it can move to passage at Step 8. This is made crystal clear in agenda item #10 in the discussion paper with Germany, Denmark and France wherein you include the very same guidance to industry on "Significant Scientific Agreement" that the GMA is demanding in their petition that you REMOVE! Seems like you're trying to make an end run around US law... if blocked in the US courts- you're clearly trying to hand this unscientific garbage to the Dispute Settlement Body of the WTO so they can use it against us... Your old colleague John Hathcock has openly announced that CRN strongly favors ongoing development of the Codex guidelines for vitamins and minerals, but CRN does NOT represent the American people, they represent multinational pharmaceutical companies, including Hoffman La Roche which got BUSTED by the Justice Department in 1999 and had to pay a $500,000,000. fine for engaging in illegal price fixing in the sale of vitamin raw materials. (They weren't the ONLY member of CRN or NNFA which got BUSTED in this illegal price fixing scam, and they helped fund the highly biased, grossly unscientific NAS paper "A Risk Assessment Model for Establishing Upper Levels for Nutrients" which has been ably rebutted by Dr.Rick Malter (whose paper I sent you with my comments), and by Darlene Sherrell and many others who've exposed the fraudulence of NAS's fluoride data. For the sake of reassurance that you are not in fact attempting to assist the multinatinal corporations make an end run around current US dietary supplement laws, I need to meet with you face to face. It is painfully obvious to us that we have NO VOICE in this process! At the two Codex meetings I've been to in Germany I could neither vote, nor speak, and my views clearly carry NO WEIGHT with Dr.Yetley who I have ON VIDEO endorsing the position of CRN... I have her and Hathcock on TAPE and its been on the world wide web for TWO YEARS along with footage of the German Chair of the meeting demanding that I turn my camcorder OFF! They have submitted comments to you in which they echo my concerns, and they have provided you with a detailed rebuttal of a 500 + page book generated by the NAS which selectively excluded numerous positive studies about vitamins which LEF cites, while playing up negative studies, and they've also drawn numerous inaccurate, grossly unscientific conclusions in an obvious effort to DEMONIZE safe vitamin substances! I would like to meet with you for the sake of discussing Bill Faloon's specific points with you, because your credability for endorsing the unscientific NAS has gone into the TOILET and I'm trying to help you rescue some shread of it for the sake of possibly helping you PR wise with the American vitamin consumer who is getting more and more annoyed. At your meetings you have made this big ludicrous display of having 6 beefy Washington Capital Police present expressly for my benefit. This stems from my outspoken statements in defense of the second amendment right to bear arms. All of the statements I have made pertinent to this have been protected first amendment speech, fully sanctioned by a number of Supreme Court decisions that I'd be happy to point you to if you like- they're all easily findable using "findlaw" on the web. I am not a violent person, and I do not come armed into Washington DC, except with that camcorder of mine and the taperecorder which all of you have seen me bring to your meetings and which you've confiscated. The only way I'd ever shoot another human being would be if they were directly threatening my life with a gun, as I have the capability to disarm a knife wielding attacker with my hands. That said, it is an undeniable fact that the Founders of this country put the second amendment into the constitution as a check and balance against corrupt government officials, but it is not a threat for me to so inform you. Read the Federalist papers to see what the Founders of this country had to say about the second amendment. This is NOT a threat- I am trying to provide you with food for thought! In this country, power flows from the PEOPLE to the GOVERNMENT, NOT the other way around! I am going to send this to Special Agent Dolan of the Washington Capital Police, and I'd be happy to discuss my views with him face to face as well for I have nothing to hide. I was put on their Watch List due to an admittedly angry email I sent to the NAS after they refused to provide me with the raw data of the risk assessment paper or the CV's of its authors (which would clearly show a conflict of interest.) On my own I finagled the CV of one of its authors: Dr.Stephen Zeisel, Chair of the Nutrition Dept. University of North Carolina and it clearly shows a gross conflict of interest as he has received MILLIONS over the years in pharmaceutical research grants, money that I'm sure he'd like to keep flowing to his Nutrition Department. Contrary to what anyone may think, I did not issue a "threat" when I stated to NAS that "hell aint half full". That wasn't a threat on my part at all, it was merely an observation, an educated guess, stemming purely from my Christian belief system... it was merely an educated guess as to the direction their souls might be sent in by an authority far greater than NAS or FDA.... by the CREATOR of these vitamins: aka GOD. Is this not something worth pondering? Rather than aid and abet the forces of evil, wouldn't all of you at FDA sleep better if you could truly know in your heart of hearts that you are REALLY protecting the public health? Wouldn't you sleep better if you were taking dangerous drugs OFF the market and not approve them in the first place rather than harrass safe vitamin substances? I have discussed all of this candidly with my friend Michelle Brill Edwards,MD, formerly with the Canadian HPB. Dr.Edwards was fired for being a whistle blower. She tried to get nefedipine removed from the Canadian market due to its extreme toxicity. She has had death threats, and despite them she has bravely spoken publicly to expose the mindset of HPB, and FDA officials- how many are not doing their jobs properly, and how they are corruptly targetting dietary supplements on behalf of powerful pharmaceutical interests. I really do need to meet face to face with you guys to discuss this stuff. I represent thousands of vitamin consumers world wide, not just Americans, and everyone sees the game you're trying to play, but its not working any more. Now you've got the Grocery Manufacturers of America on your backsides and they've got VERY deep pockets! I'm sure all of you must be wondering how you can "save face" given what for you must seem "terrible". Please, let me help! Contrary to what you probably think, I don't hate you, I get pissed now and then, but I'm the sort of person who vents with his mouth- I've never been violent and I've also never been charged with a crime. I have no criminal record of any sort. You should know that a relative of mine works with you, and I respect his work. I want you to know that I don't take a black or white view of the FDA. I can see shades of grey. I know your jobs are not easy and that you are trying your hardest. I want to help you. I read Dr.Harvey W. Wiley's book "The History of a Crime Against the Food Law" and I sympathize with the obvious pain that he felt when the Agency that he created with only the best intentions in the world got corrupted. I know that most of you are genuinely just trying to do your jobs, and you're not all conciously trying to hurt people, but never the less-- you are, wheather or not you realize it hence the need for a dialogue. America has a chance at Codex to be the leaders of the world. We have the chance to advance science and the public health. Sadly, this isn't happening. You should be advancing the science of Pauling,Rath, Cathcart, Hoffer, Osmond, Pfeiffer, Hawking, and the other orthomolecular physicians who are doing so much to save lives, but you're not. I have been kept awake at night from worry seeing this. I know what you guys probably think of me. You all think I'm some kind of crazed lunatic fanatic. Nothing could be further from the truth. There is a need for a two way dialogue about these things. There is a need for true TEAMWORK on the US Codex delegation to the CCNFSDU. This hasn't existed, and because it hasn't, I strongly support Dr.Matthias Rath's efforts to demonstrate against the meeting. The reason there were over 1000 German people of all ages out in the street at the '98 meeting of the CCNFSDU is because they are being denied a voice, they're not being listened to and this is morally wrong and you know it. Please, FDA, I extend to you the olive branch of peace. I have never come to DC armed with anything more menacing than a camcorder, but to you guys, that appears to be a VERY BIG THREAT! This lack of transparency sickens me. I am deeply saddened by what is happening in America today. My father was a Navy SEAL. Like me, he was one of the GENTELEST people around, unless provoked. He took an oath to uphold the Constitution. It MEANT something to him to be an AMERICAN, and he instilled this sense of values and pride in me. I'm not sure if that means anything to you or not due to the way in which you cater to the whim of the multinational pharmaceutical companies, and really would like the chance to talk with you at your earliest convenience.
