FDA To Allow Dietary Supplement Health Claims
USA - Washington, DC - In a move which surprised many in the
alternative
health community, the US Federal Drug Administration recently
published a
notice in the Federal Register stating that dietary
supplement manufacturers
will be allowed to market their products with health claims
that are not
unequivocally supported by scientific evidence.

evidence, according to a notice slated to be published in the
Oct. 6 Federal
Register.
This new position comes as the result of a federal appeals
court decision in
1999 (Pearson v. Shalala ) in which the court ruled that if
the health claims
could be accompanied by disclaimers that rendered them
nonmisleading, FDA had
to approve them regardless of whether they were supported by
"significant
scientific agreement."
To address this concern, the FDA has adopted an "updated
implementation
strategy" to comply with the Pearson decision before
establishing a finalized
policy. Although not meeting "significant scientific
agreement," the evidence
supporting the claim would still have to outweigh the
evidence against the
claim for FDA to allow a company to use it with "appropriate
qualifying
language." The product also could not pose a threat to
"consumer health and
safety."
