Ted, If you have unlimited funds to draw from, and know the right kind of people to help you fight the FDA, you could win (probably) in a court of law. But to stand on your rights, to appeal to the constitution, is a waste of time today. You will end up being dead right.
The judicial system is no longer concerned with the constitution, or your rights, or justice. I was a tax consultant in California for 5 years. I had legal resources to turn to for my clients, who had been to the mat with IRS and won. One of these resources, a fellow named Bill Conklin, helped folks protect themselves from intrusive and abusive govt agencies. He had about 800 clients a year, had been doing this for nearly 15 years, and had never lost. He told me one time, Terry, the courts dont care about the constitution, they only care about law. The reason I always win is because the IRS never, never, never, never follows the law. A judge may not care about the constitution, but he hates stupidity. The courts today are little better than a kangaroo court. A judge who was still loyal to the US Constitution would still not be free to follow his conscience (and keep his job). Youre not under the illusion that judges make their judgements based upon justice, untouched by politics, are you? In Canada, SOTA had set up two corporations, each one with a different, separate website. The one website sold Beck and Clark devices, with nothing to indicate what the devices were used for. No testimonies, nor anything by Beck or Clark even explaining the purpose of these devices. The other website had nothing for sale, only info and testimonies. Under the prompting of the FDA, Health Canada told SOTA that the testimonies were too much like endorsements and giving medical advice and making unfounded claims. When it was pointed out to them that the two websites were owned by separate corporations, they responded that the same people had formed both corporations, so they considered them to be the same. SOTA came within an inch of being shut down.
