On August 14, 2002, the Department of Health and Human Services
weakened vital protections in the medical Privacy Rule by expanding
dangerous loopholes that create unauthorized access to the personal
health information of millions of Americans.
***These amendments remove your right to consent or not to the use of your
private information for purposes of health care treatment, payment and
health care operations including some commercial activities.
***All information contained in your medical file may become available,
including past health information you believed was private.***
This radical change in the Privacy Rule deprives most citizens of any
meaningful ability to protect the privacy of their health information.
As weak as the previous rule was, it did offer a limited right to
patient consent that now has been abolished.
Under the amended Privacy Rule, Americans may lose all rights to consent to
the use of their medical records, forcing them to choose between
maintaining medical privacy and obtaining needed health care.
