Dear list... the following is from ' NUTRITION ACTION HEALTHLETTER '
Which of these claims can appear on a food or supplement label without
approval from the FDA..........................................
 [a] improves memory..[b] relieves stress..[c] suppresses appetite..[d]
helps reduce difficulty in falling asleep.. [e] supports the immune
system.
<<<<<<<<<<<<<<<<>>>>>>>>>>>>>>>>
ANSWER....a,b,c, and e, are called "structure / function claims " and
can be placed on a label with or without evidence to back it up.
But,can't be misleading. FDA has never said how much evidence is needed
to to substantiate a claim and not be considered misleading
[d]... is considered a disease claim, and requires approval. If the
wording had been ' For relief of occasional sleeplessness. ' it would
not require approval.
The article goes into more detail.. far more than I want to type
out, perhaps due to my having a structure / function deficit,or perhaps
I'm diseased !
Nonetheless it's a fine line.... " It's only a matter of time before
structure / function claims start showing up on cookies, chips, and soft
drink aisles."
Or... on the beer aisle,as ' JUST ONE 12-PACK NEEDED FOR RELIEF OF
OCCASIONAL SLEEPLESSNESS !! ....This would require no FDA approval.
As the snake oil salesman of yesteryear use to BARK OUT... " If you
don't belive me read the label"
