Did she mention on what basis the FDA made this order? Did any of them
challenge them? Small health food stores are generally not in any
position to make a legal stand and if their profit from selling CS is
not huge, which it likely is not, then they probably just took the path
of least resistance. Often a wise move. Choose your battles. Sounds like
a snow job to me.

A recent case brought before the local court here in Texas by the
Texas State Department of Health acting as henchmen for the FDA,
challenged the rights of Utopia Silver to post or link to customer
testimonial but did NOT require Utopia Silver to stop selling their
product. The Health Department was seeking a temporary injunction
requiring Utopia to remove medical testimonies from the site. They
actually did not even word the law suite correctly or with accurate use
of medical terms. It was a real joke. The suite stated that CS causes
conjuntiva, LOL, that is a part of the human anatomy, not a disease. CS
cures conjunctivitis. Man when their attorneys can not even word a law
suite properly you gotta wonder.

This occured in September. If the FDA were actually pulling CS from
store shelves legitimately why would they go after Utopia's posting of
testimonials, why not just shut them down? After all they are a virtual
store front, and no different from a physical store.

I think the FDA knows that a small store is not likely to have the
resources to pursue legal action and they are relying on fear, not on
actual legal power.

They did this to Stanley Jacob MD over DMSO in the 70's and ended up
having to make a public apology. They barged into his lab and demanded
his patient records. He told them NO! Just goes to show they will try
and strong arm people.
