I think what you are suppose to do is to send a Update message instead of the Re-Invite. This UPDATE will mute the channel. Update can be sent at any time,even during a INVITE transaction. Proxy will have to send forward the update to the peer. If the Peer does not support UPDATE you have no other go but to wait for the trasaction to compelete and then send the re-invite.
