12.1 Creation of a Dialog Dialogs are created through the generation of non-failure responses to requests with specific methods. Within this specification, only 2xx and 101-199 responses with a To tag, where the request was INVITE, will establish a dialog. Intuitively, I would say that a to tag in a 100 response should probably be ignored (though I can't find any text that says this). You don't ignore the 100 response, of course, you just ignore the to tag of the 100 response.
