This again seems to be an error undefined by the rfc. And as usual in these siutations, you can do what you want provided YOU don't break any rules. As an alternative to the 422, you could just ignore the Min-SE or pretend that the Min-SE was 90. Min-SE is only a "would like" header, not a "will use" header so it's not too critical as far as I can tell. Provided you don't send a Min-SE of less than 90, you're not doing anything wrong.
