A new SIP session is going to be established.

Via SIP/SDP SRTP is negotiated.

But the counterpart sends unsecured RTP.

After two seconds it stops RTP and starts the negotiated SRTP with another
SSCR.

The time-sequence of events is not clearly specified in your description.

If the offer contains RTP, then the answerer is allowed to send RTP from 
receiving the offer to sending the answer (which does not allow RTP).  However, 
there is a race between the answer and the RTP previously sent, so if the 
answerer sends RTP for a short while after sending the answer, the offerer 
cannot prove the violation.

If the offer does not contain RTP, then the answerer is not allowed to send 
RTP.  Indeed, it does not know of any port which would receive RTP.

By assumption, the answer does not contain RTP, so the offerer cannot send it.
