It is fine for a BYE to not have a Record-Route. RFC3261 states (12.1) a non target refresh request MAY add a RR header, but it will not update the remote route set. Additionally, a UAS should never reject a request (even a target refresh one) because it has a different RR set (or is missing one), as the proxies previously RRs may have decided to remove themselves from the path.
