That's a protocol error -- a 2xx containing an offer must elicit an ACK
containing a response.  The problem is that there is no useful response
that you can make. See section 2.2 of
draft-ietf-sipping-sip-offeranswer-08 for a discussion of what to do.

Yes -- a 2xx response to an INVITE without an offer must contain an
offer.
