Foreclosure by plaintiff with no standing to sue - Did the mortgage service provider or other contractor own any equity in the Note on your home when you were sued for foreclosure? Federal and state courts are now (2008) saying that they simply cannot do that, dismissing many foreclosure actions in the process. This course includes a group of documents which can be amended for your case and which seek an existing foreclosure judgment be overturned or vacated. Any pattern of such activity on the part of a party which never owned any equity in the mortgage Notes over which they sued is likely culpable for civil RICO damages and possible criminal sanctions, now that the courts have retracted their protections of this conduct, and this creates great leverage against any such plaintiff that sued you for foreclosure.
