As i use Skim mainly for highlighting this is what works: selecting  
text with "Text tool" and do "New Highight" command from "Notes" menu.  
But the "Highlight" tool accessible through the "Note Tool" menu  
(either via "Tools" menu or toolbar button) just selects text and does  
not do any markup - at least visible to me.

It seems as if the lack of marking up text applies to highlighting,  
underlining, and striking out. Again: it works if the text is selected  
and then marked up using the corresponding commands from the "Notes"  
menu.

The Tools "Text Note", "Anchcored Note", "Circle", "Box" and "Line"  
work as expected.

Does this help in any way?
