I agree with your disagreement to the previous disagreement.  i think.

This is probably due in part because no findings have ever really been made
by anyone.  It always seems to be enough to give people a prod in the right
direction until everyone is happy (see my previous comments on the spirit of
the GPL).  But one day it won't be a simple case of someone blatantly
plagiarising GPL'd work; and then what we'll end up with won't be too far
removed from the current Microsoft case - essentially deciding just where
you draw the boundaries between the kernel, libraries, API's and
applications.  If you've had chance to read any of the transcripts from the
latest case
(http://www.microsoft.com/presspass/legal/nonsettling.asp#transcripts) it
highlights how what you think would be clear can become very confused (and
then the lawyers open their mouths ...).
