Ok I gave up there were no modules for kernel 2.4.21 on the intel site.
I went out and got a netcomm modem voice/fax/data modem.

Now this is the issue.
I have used all my com ports on a really old machine. We have been using
it as a mail, and fax server. What I have done is installed the internal
netcomm modem and modules for kernel 2.4.21
installed.
When I run vgetty this is what I get in the logs

07/16 16:18:33 LT0 check for lockfiles
07/16 16:18:33 LT0 locking the line
07/16 16:18:33 LT0 lowering DTR to reset Modem

can anyone help I want one modem to accept fax and one modem to accept
voice for an answering machine. Has anyone tried this?

Thanks

Kevin
