I think if you have an acceptable use policy that contains that then you are
likely to get your self in a fair amount of trouble. Your employees have a
right to a reasonable level of privacy. Do you monitor all their phone
conversations as well?

Looking at the background of the amendment its ok to intercept emails when
involved in the normal maintenance and operation of the system. So you might
be able to have an AUP that explicitly bans the sending of image files, with
any image files sent monitored to ensure that your employees are with
holding the standards of decency expected in your company. But you can just
look at every thing on a whim. Explain what you want to do before hand and
why. And have a policy in place that deals with exceptions that does not
involve retrenchment.

As for jurisdiction, your in NSW your employees are in NSW you would be
affected.
