It is totally relevant to the uptake of FOSS in enterprise. Say I'm work for a large multinational and I'm pushing the use of FOSS internally and say I have a business case that means we can save $100,000 dollars a year by doing so. The risk assessment people in finance then come back and say that the business case is sound but they have estimated that if someone like SCO decided to sue we risk loosing $2 million and that the risk is too great or that the insurance for the risk blows the business case out of the water. You could then get someone like blackduck involved to certify that Apache say is totally free of proprietary code. Now I have no idea how much this costs but assuming its less than the numbers I made up above then you are still ahead. You budget it into your project and you keep the management happy. Of course you should also push that the compliance certification is released publicly. This would then allow that open source project to encourage other enterprise use by saying version X has been tested. Now the above might probably never happen but its the first useful scenario that I came up with after thinking whats the point.
