You suspect correctly. That Marvell controller is a piece of crap that fails to adhere to the AHCI specification. I tried to use a similar configuration with OpenBSD last year: http://comments.gmane.org/gmane.os.openbsd.misc/208651 The FreeBSD driver incorporates a number of workarounds to deal with the incorrect operation of the Marvell controller. Barring similar kludges in the illumos ahci driver, it's just not going to work.
