Best to try repairing the disk first : 

For Lion & Mountain Lion users, boot holding CMD + R to boot into the recovery 
partition, use Disk Utility to repair the drive.
For pre-Lion users, boot holding CMD + S then type : 

fsck -fy

Push return and it'll check the drive. It'll take a while as there are hundreds 
of thousands of files to check. When it's done, type :

reboot

Push return and the Mac will reboot.

If that doesn't allow you empty the trash, open up the trash in a new window, 
then open up Applications > Utilities > Terminal. Type the following : 

sudo rm -fr 

Be sure to leave a space after the '-fr', then drag the contents of the trash 
window into the Terminal window. It should load the file paths of everything 
you just dragged in (be careful with this!). Push return and type your 
password, then it should remove all the files/folders you just dragged into the 
window.

Quit Terminal and your trash should be empty. I'd suggest a reboot afterwards 
for good measure.
