Well, even if it is tossed, she can still sue him for civil damages and possibly win because reasonable doubt isn't the standard. Let's say she did have sex with him (he admits it, so it's a safe assumption), let's further *speculate* she had sex with a bellhop. The bellhop raped (or at the very least was rough enough to injure her) her. Which would be the juicer target for the inevitable civil case?
