Freeway Mural Depicting Schwarzenegger Ruled Illegal

LOS ANGELES  — A week after voters elected Arnold Schwarzenegger (search) to replace Gov.Gray Davis (search), local authorities are recalling the Terminator.

A giant advertising mural featuring Schwarzenegger's face on a building in the Cahuenga Pass is illegal and city officials have ordered it removed. The towering mural alongside Highway 101 promotes the Nov. 11 DVD release of "Terminator 3: Rise of the Machines."

The city attorney's office filed six misdemeanor criminal charges Thursday against building owner Robert Lusk Davis for allowing the 100 foot-by-40 foot mural to be erected on behalf of Warner Bros. Each count carries a possible six month jail sentence and a $1,000 fine.

Davis got permission in 1995 to paint a dinosaur on the same building and Davis said the "Terminator" ad should be allowed. "We believe we are now, and always have been, properly permitted," he said.

The ad violates city planning rules that prohibit advertising murals. Such signs are banned by an ordinance that protects the Cahuenga Pass from visual blight because it is a scenic corridor.

"I told the attorney for Warner Bros. it reflects poorly on the governor-elect to be associated with something that is illegal," said Joan Luchs, president of the Cahuenga Pass Neighborhood Association.

Luchs complained to building inspectors last weekend, said Ruben Perez, assistant bureau chief of code enforcement in the Department of Building and Safety.

"We went out Monday morning and we verified it was a violation," Perez said. "It's considered a mural sign. It's an advertisement. There is a moratorium on these kinds of signs in the city."

The city ordered that the mural be painted over, but Davis said Thursday that he would seek a court order to protect the Schwarzenegger mural.

A spokesman for City Attorney Rocky Delgadillo, a Democrat who opposed the Oct. 7 recall, denied that politics had played a role in the decision to get rid of the Schwarzenegger mural.

"This has everything to do with an illegal advertisement put on a building," Delgadillo spokesman Eric Moses said.
