Yeah, it didn't say anything about her getting suspended did it? It said she had been kissing him all day....etc.....so why wasn't she suspended as well? Hard to give a hickey if they don't sit there and let you.....

See, the suspension may have been acceptable.  Or some other school punishment and/or parental punishment.  Calling it assault is ridiculous.  Charging him with assault is ridiculous.  He gave her a hickey.  From the report she was a willing participant.
