Did I misunderstand or are you equating an external amplifier with an antenna?
From my research so far, many directional (not omidirectional which is much less) antennas exceed the gain of 4 watts EIRP and as such, these directional (yagi, shotgun etc) antennas are legal. That would apply to cantenna as well.

Making one Cantenna for your own personal use is not illegal. There is a provision that allows this as long as you don't exceed 4 W. EIRP.
