Meh, the flag is very very old and very much in the PD :) that upload copy of it isn't simply because someone tagged it that way (it's the default) when they uploaded. For example https://commons.wikimedia.org/wiki/File:Pirate_Flag_of_Jack_Rackham.svg is the exact same flag and came from https://openclipart.org/detail/47605/pirate-jack-rackham :)
