Constitution Making in South Sudan

Following its secession from Sudan in 2011, the world’s newest country
instituted a four year interim constitution in order to smoothly
accommodate its period of transition from former province to sentient
nation state.  The ratification of a permanent constitution
encompasses South Sudan’s acceptance of the challenges it faces in
constructing a legitimate socio-political dispensation in the future.
Its institution will inscribe the legality and life force of
prospective development.

The Constitution Project initiative, driven by Justice Africa and the
South Sudan Law Society, and funded by Humanity United, aims to
enhance the participation of South Sudanese citizens in the formation
of the constitution making process.  Active measures include promoting
education, information sharing, generating pluralistic dialogue
surrounding the values of the constitution, and facilitating a
coordinated program that advocates a pro-people constitution.  Justice
Africa understands that the process of constitution making is equally
as important as the final substance; it is therefore vital that the
citizens of South Sudan are included in this process.



The following excerpt is taken from the Humanity United website; it
reiterates some of the progress being made by South Sudanese civil
society in the endeavour of adding their voice to the constitution.

“In part as a result of the Justice Africa program, an engaged and
empowered civil society has been able to advocate for greater
representation in the creation of a national constitution, leading to
an expansion of representation: from a single initial representative,
to six civil society representatives participating in the drafting
committee. These civil society representatives will play a meaningful
role in drafting the document, and their participation remains vital
to assuring the South Sudan constitution reflects the voice and will
of the public.”
