When "average Americans" in a growing number of states (currently 13 by my count) form a mental association between "hey, I got a piece of spam that (forged my domain, forged my name, was sent by spamware, hid its origin, had a misleading subject, didn't label itself as an advertisement, didn't label itself as adult and was a porn ad, didn't include a removal option)" and "hey, that means I'm entitled to MONEY," I think the balance will shift.
