This was it, once I installed 4.9.10 and cleaned out everything in
Maildir/tmp things were fine and I can delete again.

I bet this is it, the vpopmail I have is a 4.9.9 beta, the date on my box is
march 20th, I think I remember it being a pre march 16th build. Two of the
users have several files in /Maildir/tmp but not my test user.
Anyway I am downloading 4.9.10 as I type and I will update everyone if this
turns out to be the issue.

I saw this problem once, when using vpopmail version 4.9.9 before 16 march,
there was a bug that vpopmail vould not delete the messages from the tmp
folder of user's maildir, and even through sqwebmail was deleting the
message from the cur or new directory, the file left in tmp would give the
described effect. check for any files in Maildir/tmp
