That patch was fine, but the .37 stable kernel tree is now dead and no
longer being maintained, so there's nothing I can do with that patch :(

I did apply the patch to the .38 stable patch queue, as you have seen,
and resolved the conflicts that I found due to the kernel versions by
hand.
