This is a note to let you know that I've just added the patch titled

    ath9k: fix a chip wakeup related crash in ath9k_start

to the 2.6.38-stable tree which can be found at:

The filename of the patch is:
     ath9k-fix-a-chip-wakeup-related-crash-in-ath9k_start.patch
and it can be found in the queue-2.6.38 subdirectory.

When the chip is still asleep when ath9k_start is called,
ath9k_hw_configpcipowersave can trigger a data bus error.
