Sorry, this is for 2.6.39.y only.

No I haven't.  The bug reports refer to 2.6.39 so the fix is clearly
needed there, and I know you will notify them when adding a patch to
the queue.  If you want third-party submissions to be cc'd then I can
do that.  (This requirement should also be noted in
Documentation/stable_kernel_rules.txt.)
