This patch is already in the 3.3-stable tree.

Ok, then how did all of these patches end up getting merged with Linus
for the 3.5-rc1 release?  Did they come in through a "stale" branch
somehow?

It is a mystery. My copy of the mainline tree shows them being merged on March 19, and March 26. That is likely the date that Linville merged them into his wireless tree; however, my recollection is that they were included during the 3.4-rcX time as fixes.

while I am writing, do you have a patch entitled "[PATCH] rtlwifi: fix for race condition when firmware is cached" for 3.3-stable. It had failed for the 3.3.7 merge, but a revised one was sent on May 18.
