Hi Patrick.  You may want to take a look at the 
Documentation/Troubleshooting links off of the OpenSolaris CIFS Server

I am pretty sure that you have the right version of ZFS if the pools 
were created with an install that had the CIFS server bits.

You can try these commands:

|# *zpool get version /pool/*
# *zfs get version /dataset/*|

You will need at least version 9 for the ZFS pool and version 3 for the 
ZFS dataset.
