That is my understanding as well. The FUSE project is being ported with 
the BSD license, which is compatible with CDDL and therefore allows FUSE 
to be included in the OpenSolaris kernel. Then DavFS will be a user land 
"application" running with in FUSE, and since it will not be adding any 
interfaces to the OpenSolaris kernel, it can remain licensed with GPLv2.

All that being said, this will need some pretty good legal reviews 
before coming into OpenSolaris as a binary...
