Sounds a lot like licensing opium dens to me.
Licensing establishments that enable unhealthy,
addictive behavior is not good social policy.

A smoking ban in public places ought to be part of a
wider effort to help people stop smoking. The tobacco
settlement money should be used to fund programs that
help people kick their habits. Perhaps this is already
being done to some extent. But I'm not aware of any of
that money being used, for example, to fund nicotine
patches or other effective treatments for tobacco
addiction.
