First - NO - if the mayor hates them all and doesn't want any of them - or if the council turns down each and every one as the mayor puts them forward - Guess what happens? According to City Charter, the top pick of the committee becomes the police chief - no other action is required by the council or mayor. We don't go back and find 5 more possibilities. Of course, like any other chief appointed, the first year is probationary, so he/she may not make it any further than that one year - up to the mayor. So the Mayor picks his #1 and submits it to council - the council votes it up or down. If up - that's the chief - if down, the mayor has to choose someone else who would also need to be confirmed by the council. Again, if it goes through all 5 and there is no agreement between the Mayor and council, the new chief is Harrington. I really cannot see that happening, but that safeguard is in the ordinance. Its my understanding that the Mayor must now choose one of the top five for the job and submit her or his name to the city council for approval. Its also my understanding that the Mayor can forward any of the five and is not bound by your recommendation. Finally, its my understanding, that if the Mayor were unhappy with the final 5 candidates, he could reject them all and ask for 5 more. Do I have the process correct? If not, can someone correct me? (I basing this upon an interview that I heard with the Mayor many months ago, maybe the process or his understanding of the process has changed since then).
