I don't agree with your analysis of the likely outcome of this case when it 
reaches the Supremes.

The liberal majority of 9th Circuit Court of Appeals made this decision. The 
Chief Judge of the 9th, Alex Kozinski (a libertarian/conservative appointed by 
Reagan), wrote the dissent:
