It's a prior restraint of political speech, which is pretty clearly unconstitutional. Of course they're going to use it mightily to their advantage. "The candidate is a child molester!" "That's slander!" "A candidate is a public figure, there fore slander doesn't apply!" and all the rabid minions ever hear is "The candidate is a child molester!" because it's not the medias job to point out that lies are lies. So they continue to make the voting process harder and harder and less desirable in the first place, because who wants to choose between the "child molester" and the "serial killer".
