Hi Peter and all, The following are some of my impressions on the changes in patent policies over some period of years.
1. Patents are now written with claimed items over a broad set of areas, with the fiurther stipulation that all of the claims not thrown out in court continue to stand. Often the terms of pre-existing patents and common practice are reworded to avoid direct search procedures. i.e. The term wire can be replaced by fine cable, metal thread, filament, metal string, and the like. The term circular can be replaced by round, ovoid, smoothly curved, uniform diameter curve, etc. 2. Patents are now no longer properly examined by peers in the disciplines involved for many reasons, such as they are too expensive, don't exist, exist but have their own axes to grind, may be lobbied by various interest groups or industry giants to control competition. 3. Having contending parties in court over wording within patents creates work for patent lawyers. I have been advised to collect pre-existing patents, documents covering common practice and the like, go ahead building my own things being prepared to be challenged by more recent patent owners.
