I don't recall what the licensing was for 1.x but licensing for 2.0 was
not free.  3.0 follows the 2.0 model: you can buy licenses per-appliance,
in blocks of 20 or 100 appliances, or for an unlimited number of units
deployed at a single site.  I don't have the 3.0 prices handy.  I recall
them being a few percent higher than the 2.0 prices except for the "site"
license which is a lot higher for 3.0.  I keep trying to explain that
it'd be a really good idea to give free licenses for small numbers of
units used for non-commercial purposes.  That hasn't happened yet.

If you bought licenses for 2.0 then you should be able to upgrade those
for  something close to whatever the difference in price is.  Depending
on what kind of organization you are and how good a relationship with 
Sun you have, you might qualify for a discount on licenses just like on 
anything else.

There is no license enforcement in the product.  It's possible that
Sun Support might check for proper licensing when taking support calls.
Other than that it's essentially an honor system.
